TERMS OF SALE FOR CONSUMERS

BACKGROUND

These Terms govern the sale of digital educational content (“Paid Content”) by Sweet Elements Chester Limited to consumers.

By purchasing Paid Content, you agree to be bound by these Terms.

1. Definitions

“Paid Content”
One-off digital educational products including, but not limited to, PDFs, manuals, frameworks, templates, and recorded educational material.

“We / Us / Our”

Sweet Elements Chester Limited is a private limited company registered in England & Wales.

3. Age Restriction

You must be at least 16 years old to purchase Paid Content.

4. Digital Products Only

All products sold are digital only.
No physical goods are supplied.

5. Pricing & VAT

Prices are displayed in the currency shown at checkout.

Where applicable, UK VAT will be applied in accordance with current legislation.

For customers outside the UK, VAT or local taxes may be calculated based on your location and applicable laws at checkout.

If a pricing error occurs, we reserve the right to cancel the order and issue a full refund.

6. Orders & Payment

Payment is taken in full at checkout.

A legally binding contract is formed once you receive an order confirmation email.

7. Delivery of Digital Content

Paid Content is made available immediately after purchase via download or account access.

8. No Cooling-Off Once Accessed (IMPORTANT)

By purchasing Paid Content, you expressly consent to immediate access.

Once access is provided, you acknowledge that you lose your statutory right to cancel, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for digital content.

9. Refunds

Due to the nature of digital content:

No refunds are offered once access is provided, except where:

  • the content is faulty,

  • the content is not as described, or

  • a refund is required by law.

10. Licence & Permitted Use (STRICT)

You are granted a personal, non-transferable, non-commercial licence to use the Paid Content.

You may not:

  • share, resell, reproduce, or distribute the content

  • use it to create courses, workshops, client materials, or derivative products

  • upload it to AI systems, databases, or file-sharing platforms

  • present it as your own work or intellectual property

All intellectual property rights remain the exclusive property of Sweet Elements Chester Limited.

11. Educational Disclaimer

Paid Content is provided for educational purposes only and does not constitute professional, legal, or financial advice.

12. Liability

We are responsible for any loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence.

We do not accept liability for any loss that is not foreseeable or for any indirect or consequential loss.

Nothing in these Terms limits or excludes our liability for:

• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation
• any matter for which liability cannot be excluded or limited by law

13. Governing Law & Jurisdiction

These Terms are governed by English law.

Consumers may bring proceedings in UK courts based on their place of residence.

TERMS OF SALE FOR BUSINESS CUSTOMERS

Where Paid Content is purchased in the course of business:

  • All sales are final once access is provided

  • The licence granted is for internal reference only

  • No resale, redistribution, training, or client use is permitted

  • No derivative works may be created

Liability Limitation (Business Customers)

Our total liability is limited to the greater of ÂŁ10 or 10% of the purchase price, except where liability cannot be limited by law.
